The ICJ can only hear a dispute when one or more states (countries) are requested to do so, it cannot deal with any dispute on its initiative. The ICJ can only give advisory opinions on legal questions on the request of the United Nations organs, special agencies or a concerned organization authorized to make such requests. In such a situation, a separate Modi government goes to ICJ with this issue against Pakistan, then ICJ can advise both countries.
